1. Scope of application

1.1 These General Terms and Conditions (GTC) apply to the use of the websites jungkraut.ch and jungkraut.com and all associated subdomains, and to all orders placed with Jungkraut AG, Baarerstrasse 2, 6300 Zug, Switzerland, phone +41 44 515 60 08, hello@jungkraut.com.

1.2 By confirming your order, you accept these GTC.

2. Offer and conclusion of contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

2.2 By clicking the "Buy", "Buy now" or "Pay" button, you place a binding order.

2.3 The contract is concluded when Jungkraut AG confirms the dispatch of the goods by email or delivers the goods. For digital products (e. g. gift vouchers), the contract is concluded immediately.

3. Right of withdrawal

3.1 Consumers in the EU are entitled to the statutory 14-day right of withdrawal under Directive 2011/83/EU on consumer rights and the respective national implementing law (in Germany §§ 312g, 355 BGB). Jungkraut AG voluntarily extends this right of withdrawal to 30 days from receipt of the goods and grants it to the same extent to customers in Switzerland.

3.2 Details, exceptions and the model withdrawal form are set out in the withdrawal instructions. For first purchases of skincare products, the 30-day satisfaction guarantee additionally applies.

3.3 Returns are made using a pre-paid return label; Jungkraut AG covers the return shipping costs for returns from Switzerland and the EU.

3.4 Refunds are made without delay, at the latest 14 days after receipt of the goods or proof of return shipment, to the original payment method.

4. Prices and shipping costs

4.1 The stated prices include statutory VAT and other price components.

4.2 Shipping costs may apply in addition and are shown separately during the order process.

4.3 Delivery areas, shipping costs and delivery times are set out in the shipping policy in its current version.

4.4 Jungkraut AG reserves the right to change prices and offers at any time. The prices at the time of the order are binding.

5. Terms of delivery

5.1 Delivery is made to Switzerland and to EU countries in accordance with the shipping policy.

5.2 Partial deliveries are possible at no additional cost to you.

5.3 After two unsuccessful delivery attempts, Jungkraut AG may withdraw from the contract; payments made will be refunded.

6. Terms of payment

6.1 Payment is made using the payment methods offered during the order process. Processing is handled via Shopify Payments or the respective connected payment service provider.

6.2 Offsetting against counterclaims that are not recognised or have not been legally established is excluded.

6.3 You may only exercise a right of retention if your claims are based on the same contractual relationship.

7. Retention of title

The goods remain the property of Jungkraut AG until payment has been made in full.

8. Warranty

8.1 Jungkraut AG provides warranty through subsequent fulfilment (rectification of defects or replacement delivery).

8.2 If subsequent fulfilment fails, you may withdraw from the contract. This does not apply to insignificant defects.

9. Liability

Jungkraut AG excludes liability for slightly negligent breaches of contract. This also applies to auxiliary persons and substitutes.

10. Data protection

Jungkraut AG complies with data protection requirements. Further information can be found in the privacy policy on jungkraut.ch.

11. AI-assisted content and communication

Jungkraut AG uses artificial intelligence (AI) to create and improve website content. Texts, images and other content may be partially AI-enhanced or fully AI-generated; editorial responsibility remains with Jungkraut AG. Responses in customer communication (e. g. chat or email) may also be created with AI support or entirely AI-based in order to answer enquiries faster and better. Details are set out in the privacy policy.

12. Place of jurisdiction and applicable law

12.1 The purchase contract is governed by Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

12.2 The place of jurisdiction is Zug, Switzerland, to the extent permitted by law.

13. Final provisions

Should any provision of these GTC be invalid, the remainder of the contract remains valid. The relevant statutory provisions apply in place of the invalid provision.
